Sentence in the Budapest-trials

Tobi got sentenced to 22month in prison

Six month after the opening of the trial against 3 german and italian
Antifascists, the second court sentenced Tobi to 22month of prison.
Aside Tobi, another comrade from Germany and Ilaria from Italy are
accused to be part of a criminal organization.
Ilaria is additionally accused of direct participation in the attacks,
which could lead to a more than 10years- sentence.
Tobi and Ilaria are in aggravated pretrial detention since 16 month,
under inhumane conditions.

Tobi had accepted the indictment in the pretrial, since a fair trial was
not to be expected.
Afterwards, there has been disagreements between the court, prosecutor
and his lawyer about the hight of the sentence.
The court has decided for 3 years, Tobi’s lawyer had put in a legal
caveat.
The prosecutor demanded a higher sentence. Today’s sentence is much
lower than what it could have been, following the prosecutors demand.
Since Tobi has already done more than 2/3 due to the long pretrial
detention, it would be possible to get him out on probation soon. The
decision about this is made by a different court, dates aren’t known
yet.

The grounds for the judgment are showing another time the political line
and the strong determination of the court to punish Antifascists.
The court pretty much said that there isn’t any proves that Tobi has
been active in a criminal organization in Hungary. The judgment is only
based on the german investigations in the  Antifa-Ost-Trials in Germany.
The goal to repress Antifas is obvious.

We are relieved that Tobi’s release from hungarian prison might come
closer.
 Ilaria succeeded to get house arrest in Hungary until the end of trial.
Her candidature for the European Parliament might give her the
possibility to evade the still running trial.
Different than Tobi, the two comrades didn’t accept their guilt. The
political trial is still going on, with no precise end. At the third
day, the court announced that they want to be done in September or
October, but nobody knows if the timeframe will be kept.

Meanwhile, Maja is still in extradition detention in Dresden and waits
for the decision of the court in Berlin.
As a non binary person, they are supposed to be extradited into a
queerphobe state.
Same as Hanna and further comrades on the run, they are threatened to be
moved to Hungary.
